Uncurl - AI Posture Analysis

Agreement to Terms

These Terms are between you and DTC Brands US LLC, doing business as Uncurl. By downloading, installing, or using the Uncurl mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

Uncurl is a mobile application that provides:

• AI-powered posture analysis using photos and videos
• Personalized exercise recommendations
• Progress tracking over time
• Educational content about posture health

Important: Uncurl is for informational and educational purposes only. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

2. Eligibility

You must be at least 13 years old to use Uncurl. By using the App, you represent that you meet this requirement.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. AI-Powered Analysis

4.1 Third-Party AI Processing

Uncurl uses Apple Vision for on-device standing body-pose measurements when supported. When enabled and with your explicit consent, Uncurl sends photos/videos through its server to Google's Gemini AI for cloud analysis. Using on-device analysis does not require sharing media with Google. For analysis, you:

• Choose whether to consent to Google cloud processing before media is uploaded
• Acknowledge that AI analysis may not be 100% accurate
• Understand that results are for informational purposes only

4.2 Accuracy Disclaimer

AI-generated posture analysis:

• Is not a substitute for professional medical evaluation
• May contain errors or inaccuracies
• Should not be used to diagnose or treat medical conditions

Always consult a qualified healthcare professional for medical advice.

5. Subscription and Payments

5.1 Pricing

• Uncurl offers an annual auto-renewing subscription; the App Store displays the local price before purchase
• Any free trial is available only when Apple confirms eligibility; the App Store offer determines its duration and renewal price
• Prices may vary by region and are subject to change
• All fees are in the currency displayed at purchase

5.2 Billing

• Subscriptions are billed through Apple's App Store
• Payment is charged to your Apple ID account
• Subscriptions auto-renew unless cancelled 24 hours before the renewal date

5.3 Cancellation

• You may cancel anytime through your Apple ID settings
• Cancellation takes effect at the end of the current billing period
• Refund eligibility is determined by Apple and applicable consumer law

5.4 Refunds

Refund requests are handled by Apple according to their refund policy. Request a refund at https://reportaproblem.apple.com. Restore purchases from the subscription screen using the Apple Account used to subscribe. Account deletion does not cancel your Apple subscription.

5A. Independent Coaching

Adam Trojanowski is a Rehab & Mobility Coach, founder of Total BodyFix Therapy, associated with BodyFixByAdam LLC, UAE (@bodyfixbyadam). He is not presented as a licensed physical therapist or doctor. Sessions are provided and charged by BodyFixByAdam independently of Uncurl, under the coach's own booking terms. Uncurl may receive an off-platform referral fee. Coaching is not included in the Uncurl subscription. In-app paid session booking is not offered in this version.

After you accept the disclosure, the handoff sends an opaque referral identifier and generic campaign tags only. Your posture photos and analysis are never shared with the coach. Information you submit directly to the coach is subject to his own privacy practices. Contact the coach for session scheduling, cancellation and payment questions.

6. User Content

6.1 Your Content

You retain ownership of photos and videos you submit. By using the App, you grant us a limited license to:

• Process your content for posture analysis
• Store analysis results linked to your account
• Use anonymized, aggregated data to improve our services

6.2 Content Guidelines

You agree not to submit content that:

• Violates any law or regulation
• Infringes on others' rights
• Contains malware or harmful code
• Is inappropriate or offensive

7. Intellectual Property

7.1 Our Property

The App, including its design, features, content, and trademarks, is owned by Uncurl and protected by intellectual property laws. You may not:

• Copy, modify, or distribute the App
• Reverse engineer or decompile the App
• Use our trademarks without permission

7.2 Feedback

Any feedback, suggestions, or ideas you provide may be used by us without obligation to you.

8. Health Disclaimer

Uncurl is not a medical service.

• The App does not provide medical advice
• Analysis results are AI-generated estimates, not diagnoses
• Exercise recommendations are general guidance, not personalized medical treatment
• You should consult a healthcare provider before starting any exercise program
• Stop any exercise that causes pain and seek medical attention

If you have a medical condition, consult your doctor before using Uncurl.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Uncurl is provided "AS IS" without warranties of any kind
• We do not guarantee the accuracy of AI analysis
• We are not liable for any injuries resulting from exercises
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the App in the past 12 months

10. Indemnification

You agree to indemnify and hold harmless Uncurl, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

11. Termination

11.1 By You

You may stop using the App and delete your account at any time.

11.2 By Us

We may suspend or terminate your access if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the service or other users

11.3 Effect of Termination

Upon termination:

• Your right to use the App ends immediately
• We may delete your data (except as required by law)
• Provisions that should survive termination will remain in effect

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

• In-app notifications
• Email to your registered address
• Updated "Last Updated" date

Continued use after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of State of Wyoming, United States, without regard to conflict of law principles.

14. Dispute Resolution

14.1 Informal Resolution

Before filing a claim, you agree to contact us at support@getuncurl.com to attempt informal resolution.

14.2 Arbitration

Any disputes not resolved informally will be resolved through binding arbitration, except for claims that may be brought in small claims court.

14.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

15. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Uncurl
• Severability: If any provision is unenforceable, the remainder stays in effect
• Waiver: Failure to enforce a right does not waive that right
• Assignment: You may not assign these Terms; we may assign them freely
